TERMS OF SERVICE

These Terms of Service ("Terms") govern your access to https://www.cuffstore.com (the "Site") and your purchases from Clawfoot Productions LLC, doing business as Cuffstore ("Cuffstore," "we," "us," or "our"). Our store is hosted by Shopify, which provides the ecommerce platform we use.

By using the Site, creating an account, or placing an order, you agree to these Terms and our Privacy Policy. At checkout, the version presented or linked when you place your order applies to that transaction. If you do not agree, do not use the Site or place an order.

1. ADULTS ONLY

The Site and its products are intended only for adults who are at least 18 years old and legally able to enter a binding contract. Minors may not browse the Site, create an account, or purchase products, even with parental permission. You represent that you are at least 18. We may use reasonable age-verification measures and may refuse or cancel an order if we cannot verify eligibility.

You are responsible for knowing and complying with laws that apply to your purchase, possession, and use of a product in your location. We do not ship where a sale is prohibited.

2. PRODUCTS, SAFETY, AND HYGIENE

Product descriptions, photographs, dimensions, materials, compatibility information, and prices are provided as accurately as reasonably possible. Screen settings and manufacturing variations may affect color or appearance. We may correct errors and update or discontinue products prospectively.

Read and follow all product instructions, warnings, cleaning directions, and manufacturer information before use. Inspect a product before each use and stop using it if it is damaged, causes pain or irritation, or appears unsafe. Use products only as intended. Product information on the Site is general information and is not medical advice. Consult a qualified healthcare professional if you have a medical condition, allergy, implanted device, injury, pregnancy-related concern, or other question that could affect safe use.

Our voluntary return program excludes items designed to come into contact with bodily fluids for health and hygiene reasons, but only to the extent permitted by law. This voluntary restriction does not curtail any statutory withdrawal right. No voluntary return restriction eliminates rights or remedies for defective, damaged, misdescribed, incorrect, or otherwise nonconforming goods. Other return and exchange rules are stated in our Return and Refund Policy at https://www.cuffstore.com/policies/refund-policy, which is incorporated into these Terms. The version presented or linked at checkout applies to that order.

3. PRICES, TAXES, AND PAYMENT

Prices are shown in the currency identified at checkout and may change before an order is accepted. You are responsible for applicable taxes, shipping charges, and other charges disclosed before you submit the order. You authorize us and our payment processors to charge the payment method you provide for the total shown at checkout. Payment authorization does not mean we have accepted your order.

You must provide current, complete, and accurate billing, shipping, contact, and account information. You may not use a payment method without authorization.

4. ORDERS, ACCEPTANCE, AND CANCELLATION

Your order is an offer to buy. An automated order confirmation only acknowledges receipt. We accept an order when we send a shipment confirmation or otherwise expressly confirm acceptance. We may reasonably reject, limit, or cancel an order before shipment because of suspected fraud, payment or pricing error, product unavailability, legal restrictions, suspected resale, or inability to deliver.

If we cancel an order after payment has been captured, we will promptly issue a refund to the original payment method. Your bank or payment provider controls when the credit appears. Contact us promptly if you request a cancellation; we cannot guarantee cancellation after fulfillment begins.

5. SHIPPING, DELAYS, AND DELIVERY

Available shipping methods, charges, destination restrictions, and any estimated delivery dates are displayed during checkout or on the Site. Delivery dates are estimates unless we expressly state otherwise. We will ship within the time stated at checkout or, if no time is stated, within the time required by applicable law.

If we cannot ship on time, we will provide any notice, cancellation option, and refund required by law. We may obtain your consent to a revised shipment date where permitted. You are responsible for providing a complete, deliverable address. Risk of loss and title pass only as allowed by applicable law; nothing in these Terms changes mandatory rights concerning lost, damaged, or misdelivered goods.

Domestic orders are shipped in discreet, unmarked packaging. Outside the United States, adult products other than collars are eligible for shipment only to Canada and Australia. Collars may be shipped to other destinations supported at checkout, subject to carrier availability and applicable law. International orders are currently shipped with duties and import taxes unpaid (commonly described as a DAP or customer-import-charge posture), unless checkout expressly states otherwise for a particular order. We do not currently collect duties or import taxes at checkout or promise delivered-duty-paid (DDP) service. The recipient may be treated as importer and may have to pay import duties, import taxes, customs-clearance charges, brokerage fees, or similar destination charges. Displaying a destination, currency, or shipping option does not represent that we are registered for, collect, or remit VAT, GST, sales tax, duties, or other taxes there. This allocation applies only to the extent permitted by applicable law. See the Shipping Policy for details.

6. RETURNS, REFUNDS, AND DEFECTIVE PRODUCTS

Subject to the voluntary-return hygiene exclusion above, the current Return and Refund Policy permits new, unworn items in their original packaging to be returned or exchanged for a like item within 30 days after delivery or receipt. The buyer pays return shipping. Returns are subject to a 20% restocking fee. Exchanges are subject to the fees stated in that Policy: currently $15 for small items and $20 for large items weighing four pounds or more. International customers pay shipping both ways for exchanges. If the postal service returns an international shipment, the item price is refunded but shipping charges are not. Each term applies only to the extent permitted by applicable law.

In addition to other applicable rights, our voluntary defective-arrival guarantee provides a replacement if a product arrives defective and the buyer contacts us promptly and returns it in accordance with our instructions within 14 days after delivery or receipt. The buyer pays return shipping under this voluntary guarantee except where applicable law requires otherwise. This 14-day guarantee does not shorten or replace any longer express product or manufacturer warranty or any statutory warranty, conformity right, reimbursement right, or other remedy that applicable law does not allow us to waive.

Any voluntary return restriction, including a hygiene restriction, does not eliminate rights or remedies for defective, misdescribed, or nonconforming goods that applicable law does not permit us to waive. Approved refunds are issued to the original payment method unless the law requires another method.

7. ACCOUNTS AND ACCEPTABLE USE

You are responsible for keeping account credentials confidential and for activity under your account. Notify us promptly of suspected unauthorized use.

You may not use the Site to violate law or another person's rights; submit false or misleading information; impersonate another person; distribute malware; interfere with security or operation; scrape, crawl, or access the Site by automated means without permission; collect another person's personal information; spam or phish; or infringe intellectual property rights. We may suspend or terminate access for a violation, but termination does not affect rights or obligations already accrued.

8. INTELLECTUAL PROPERTY

The Site and its text, graphics, logos, photographs, software, and other content are owned by or licensed to Cuffstore and protected by applicable law. We grant you a limited, revocable, nonexclusive, nontransferable license to use the Site for personal shopping and lawful, noncommercial purposes. No other rights are granted.

9. REVIEWS, FEEDBACK, AND USER CONTENT

You retain ownership of reviews, photographs, feedback, and other content you submit ("User Content"). You grant Cuffstore a nonexclusive, worldwide, royalty-free, sublicensable license to host, reproduce, format, display, distribute, and otherwise use that User Content to operate, improve, and promote Cuffstore and its products, for as long as the applicable intellectual-property rights exist. This is a license, not a transfer of ownership. You may ask us to stop future promotional use by contacting us, although removal may not be possible for materials already produced or where retention is legally required.

You represent that you have the rights needed to submit User Content and that it is accurate and does not violate law or another person's rights. We may moderate or remove content for lawful reasons. We will not condition a contract on your waiving rights in an honest review, and nothing in these Terms prohibits a truthful review or lawful report to a government agency.

10. THIRD-PARTY SERVICES AND LINKS

The Site may rely on or link to services operated by others, including Shopify, payment processors, delivery providers, and social or analytics services. Their own terms and privacy practices may apply when you interact with them. We are not responsible for an unaffiliated service's content or conduct, but this provision does not limit responsibility that applicable law places on us.

11. PRIVACY

Our Privacy Policy at https://www.cuffstore.com/policies/privacy-policy explains how we handle personal information and is incorporated into these Terms. If these Terms conflict with the Privacy Policy on a privacy matter, the Privacy Policy controls.

12. WARRANTIES

We honor any express warranty stated in a product listing or supplied with a product. We do not create any additional express warranty through these Terms.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AND EXCEPT FOR AN EXPRESS WRITTEN WARRANTY OR A RIGHT THAT CANNOT BE DISCLAIMED, THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM IMPLIED WARRANTIES RELATING TO THE SITE, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

NO DISCLAIMER IN THESE TERMS EXCLUDES AN IMPLIED WARRANTY THAT APPLICABLE LAW DOES NOT ALLOW US TO EXCLUDE. ANY PRODUCT-SPECIFIC WARRANTY OR REMEDY IS GOVERNED BY THE PRODUCT LISTING, DOCUMENTATION PROVIDED WITH THE PRODUCT, AND APPLICABLE LAW. Some jurisdictions do not permit certain warranty exclusions, so those exclusions may not apply to you.

13. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CUFFSTORE AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, ARISING FROM THE SITE OR THESE TERMS, EVEN IF ADVISED THAT SUCH DAMAGES ARE POSSIBLE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY FOR A CLAIM RELATING TO A PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID FOR THAT PRODUCT, AND OUR AGGREGATE LIABILITY FOR A CLAIM RELATING ONLY TO THE SITE WILL NOT EXCEED $100.

These limitations do not apply to personal injury or property damage caused by a defective consumer product to the extent a limitation is prohibited; fraud or fraudulent misrepresentation; gross negligence; willful misconduct; violation of an applicable consumer-protection statute; breach of an express written warranty; or any liability or remedy that cannot legally be excluded or limited. Your jurisdiction may provide additional rights.

14. INDEMNITY

To the extent permitted by law, you agree to indemnify Cuffstore against a third-party claim arising from your unlawful misuse of the Site, your material breach of these Terms, or your infringement of another person's rights. This obligation does not apply to the extent a claim was caused by Cuffstore, a product defect, or conduct for which applicable law makes Cuffstore responsible.

15. CHANGES TO THE SITE OR THESE TERMS

We may change or discontinue Site features. We may update these Terms by posting a revised version and changing the updated date. We will provide additional notice when required by law. Material changes apply prospectively from their effective date and do not retroactively alter an accepted order unless you expressly agree or the law requires it.

16. GOVERNING LAW AND VENUE

Texas law governs these Terms, without regard to conflict-of-law rules. Subject to any non-waivable right to bring a claim elsewhere, the state and federal courts serving Williamson County, Texas have exclusive jurisdiction over disputes arising from these Terms or the Site, and each party consents to that jurisdiction. This section does not deprive you of mandatory consumer protections or venue rights under the law of your residence.

17. GENERAL TERMS

If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remainder will remain effective. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a merger, financing, reorganization, or sale of our business, subject to applicable law. These Terms, the Privacy Policy, the Return and Refund Policy, the Shipping Policy, and the order-specific terms presented at checkout form the agreement concerning your use and purchase. Order-specific terms control for that order if they conflict with these general Terms.

Nothing in these Terms limits a right or remedy that applicable law does not allow a consumer to waive.
